General Conditions of Sale and General Conditions of Use Rental of Gîtes in the countryside ""La Petite Clavelie""
You reserve a furnished seasonal rental, located at a place called ""La Petite Clavelie"", 24600 RIBERAC.
The Gîtes in the countryside ""La Petite Clavelie"" are owned by the Scadouche company, registered under number 899 522 098 RCS of Villefranche Tarare, managed by Nicolas and Cécily BERGIER.

1 – Reservation, rental contract and payment
The reservation with the ""La Petite Clavelie"" country cottages will become firm upon receipt of a deposit of 50% of the rental price, as indicated on the website, depending on the period chosen, by bank transfer. , checks or credit card, within 8 days of receipt of the reservation confirmation email.
If after 8 days the deposit has not been received by the owners, the reservation will be considered null and void. The property will then be put back for rental.
Personal data will also be deleted.
The balance of the reservation must be sent to the owners, by bank transfer or check, 30 days before the start of the stay, otherwise the stay will be considered canceled by the tenants. The property will then be rented out to other clients and the deposit will be kept in full by the owners.
In the event of a last minute reservation, and especially within a period of less than 30 days between the reservation and the start of the stay, full payment of the rental will be requested when booking. Under article L221-21-8 of the Consumer Code, any reservation made by mail, telephone and website does not benefit from any right of withdrawal. In fact, upon receipt of the deposit, no withdrawal period is possible.
2 – Price of the stay
No dispute concerning the price of the stay can be taken into account after booking and payment of the deposit.
It is up to the tenants to assess, before signing, whether the price suits them.
The rental price does not include end-of-stay cleaning which is optional. Tenants are then asked to leave the premises in an impeccable state of cleanliness if the cleaning option is not chosen by them, otherwise the deposit check will be cashed by the owners.
The following charges are not included in the rental price and must be paid at the start and end of the stay, when the keys are handed over and the inventory is taken:
- The tourist tax, fixed proportionally to the rental price and the number of occupants, and paid to the Community of Municipalities. Only adults are subject to tourist tax.
- Fixed price for exceeding electricity and heating consumption of €0.20 including tax per kWh, in the event of a possible exceeding of the threshold of 60 kWh per week determined by the owners.
3 – Duration of stay
The tenant, signatory of the rental contract, agrees to rent the property only for the period determined in the contract and cannot, under any circumstances, claim any right to remain in the premises, at the expiration of the rental period. rental initially provided for in the contract, unless expressly agreed by the owners.
The rental contract is nominative and cannot be transferred, even partially, to other third parties, unless expressly agreed by the owners.
In the event of non-compliance with this condition, the contract may be terminated and the tenant will not be able to claim any reimbursement or compensation.
4 – Arrival and Departure
For arrivals, the tenant must arrive between 5 p.m. and 8 p.m.
In the event of late or delayed arrival, the tenant must contact the owners, whose contact details are indicated at the top of this document.
No early arrival will be accepted, unless otherwise agreed by the owners.
The tenant undertakes to vacate the rented gîte at 12 p.m. on the day the rental ends, so as to allow in-depth maintenance for subsequent tenants.
An inventory of fixtures upon entry and exit will be carried out by the owners themselves or by a trusted person, in the event of their absence.
A security deposit (deposit check), in the amount of €300 or €500, depending on the rental cottage, will be requested when the keys are handed over and will be destroyed, within 1 month, if no damage has been noted. upon departure and inventory of premises upon departure.
In fact, the tenant will assume, in addition to the rental costs, any damage caused to the accommodation as well as the cost of replacing any lost, destroyed or damaged object.
In the event of breakage or deterioration, the tenant is asked not to replace the broken item himself or to repair it himself, but to inform the owners.
Furthermore, tenants are asked to empty all of their trash before their departure, that the refrigerator has been cleared of all its contents and that the dishes are washed and put away.
5 – Use of the premises
The tenant must ensure the peaceful nature of the rental and make use of it, in accordance with the destination of the premises. The tenant undertakes to use the rented premises with care.
The Gîtes à la Campagne ""La Petite Clavelie"" are non-smoking. It is therefore strictly forbidden to smoke and/or vape inside the premises. Ashtrays are placed outside and cigarette butts should be thrown into these and not in the open.
The Gîtes in the countryside ""La Petite Clavelie"" belong to a property, made up of other furnished rentals, the tenant is asked in particular to respect the tranquility of the premises and of the other tenants, particularly in the morning and in the evening.
The tenant undertakes to occupy the rented premises personally, with his family or friends, within the limit of the maximum accommodation capacity of each gîte.
For any request to accommodate additional people, a written request must be sent to the owners, who reserve the right to refuse. In this specific case, if the tenant then decides to cancel the rental, the owner will keep the deposits paid because the cancellation would be at the sole initiative of the tenant.
Likewise, if despite the refusal of the owners, the rental exceeds the maximum number of people authorized in the gîte, the owners may, unilaterally, decide to end the current rental contract, without the tenant, Having not respected the rental conditions, cannot claim any reimbursement or compensation.
Tenants are asked to respect the bedding and in particular not to sleep on the mattress pad, bedding, cushions and duvets. If applicable, the price of washing and cleaning or even replacing duvets, mattresses, pillows, etc. which may have been stained will be retained.
The tenant must absolutely refrain from throwing, into the sinks, toilets, sinks and showers, etc. objects likely to clog the pipes, including hygiene products, apart from toilet paper, otherwise he will be liable for the costs incurred by the repair of these devices and the labor costs incurred.
All trash bins in the Gîtes must be emptied regularly and, moreover, before the tenant's final departure.
These will be placed in the bins provided for this purpose.
6 - Outdoor spaces
The Gîtes in the countryside ""La Petite Clavelie"" are nestled on a plot of more than 6 hectares, not enclosed. Supervision of children, especially younger ones, is the responsibility of tenants and cannot be the responsibility of owners.
Each space linked to seasonal rental is determined, without the hosts of the respective lodgings seeing each other or disturbing each other. A real privacy of each place is thus preserved, if everyone stays in the spaces allocated to them, in direct proximity to the accommodation.
All tenants are therefore asked to respect these boundaries of spaces, in order to respect the peace and quiet of all. Furthermore, you are asked to respect others by avoiding inappropriate noise pollution in the morning or evening.
Access to the woods and meadows is not restrictive and open to all tenants, provided that they do not visibly disturb guests who have their accommodation nearby. It is also requested not to throw garbage and various rubbish in the park, the land and the adjoining woods, in order to respect the ecosystem of the place as well as the tranquility of the other tenants.
7 – Welcoming pets
The reception of domestic animals can be considered by the rental of the Gîtes in the countryside ""La Petite Clavelie"", under certain conditions, and after express agreement of the owners:
- Valid anti-rabies vaccination;
- Identification by tattoo or chip;
- All animals must be supervised and secured, in order not to create an incident on the property and with respect to the tenants of other gîtes;
- The property being unfenced, it is up to the tenant to ensure that their animal does not escape their supervision. The owners cannot be held responsible for any accident or incident involving a tenant's animal.
- ""Dangerous, attack, defense and guard"" dogs, classified in category 1 and 2, are not accepted;
- The tenant remains responsible for the hygiene of the land and the rented property, otherwise his security deposit will not be returned;
- For hygienic reasons, animals are not allowed to enter the rooms and must under no circumstances be allowed to go up and sleep on the beds, armchairs and sofas in the gîte.
In the event of non-compliance with all of these conditions, the rental contract may be terminated and the tenant cannot claim any reimbursement or compensation.
8 – Cancellation of the stay
Any cancellation request from the tenant must be made in writing, by registered letter with acknowledgment of receipt, to the owners of the ""La Petite Clavelie"" country cottages.
Except in cases of force majeure, linked to an event beyond the control of tenants and owners, and in particular health restrictions linked to the Covid-19 pandemic, no costs linked to the cancellation of your stay will be impacted, until 7 days before the initial start of the stay.
Apart from these exceptional situations, the conditions for canceling your stay are indicated in the reservation confirmation.
- If the tenant does not appear or does not show up, in any way whatsoever, within 24 hours following the start of the stay, as indicated in the rental contract, the contract then becomes void and the property may be rented to other people.
The owners keep the deposit and the balance of the rental.
- If tenants postpone or shorten their stay, of their own doing, the rental price remains in full with the owners and no reimbursement will be made.
These cancellation costs can be covered by ""Cancellation"" insurance to be taken out individually by the tenant.
If the cancellation of the stay is due to the owners, due to the impossibility of providing the accommodation in a satisfactory manner, and excluding force majeure beyond their control, the entire amount paid by the tenant will be refunded. .
9 – Insurance
The tenant is responsible for all damage occurring due to him, as well as all damage occurring due to people and animals accompanying him.
The tenant must provide, when handing over the keys at the entrance to the premises, a certificate of ""civil liability and resort"" insurance, valid for the entire stay.
10 – Modification of substantial elements of the contract
When, before the planned start date of the stay, the owners find themselves forced to substantially modify one or more elements of the rental contract, they inform the tenant by registered letter with acknowledgment of receipt.
It can then be decided:
- To cancel the stay, under cover of full reimbursement of the sums incurred by the tenants;
- To modify the dates of the stay for a later arrival;
In the latter case, an amendment to the contract will then be signed by both parties.
11 – Disputes
In the event of a dispute, if all prior amicable conciliations have failed, only the District Court of the location of the rental has jurisdiction.
Any reservation is considered accepted, with all the conditions listed above.
